Who can request medical-record copies?

The patient may request all or part of their existing records; third-party routes have separate conditions.

Article 21 expressly allows patients to request access or copies of all or part of their records. It includes both amended records and the originals before an addition or correction. Identity must be confirmed under Rule 13-3.

A request can therefore specify a period and categories without treating every document held by the institution as a newly written certificate. A relative or designated agent uses the applicable statutory route, not the patient’s identity alone.

For example, a request can name an outpatient record for a stated period, an operation record or an imaging report. These examples identify existing material; they are not a requirement to order a full chart. A receiving clinician can clarify the range needed for continuing care. The institution holding the record can clarify whether the material exists. Keeping those questions separate avoids treating a broad request as proof that every category was created.

Which documents count as medical-record copies?

Existing records and first issuance of a diagnosis certificate have different bases.

The Ministry’s 2022 guidance describes records already created and held by the institution. It includes clinical records and information available from them, such as an existing certificate copy.

It separately identifies first issuance of a diagnosis certificate, opinion or prescription. A copy request does not ask a doctor to reach a new diagnosis, rewrite a clinical assessment or translate every entry. Identify which of these tasks the institution is being asked to perform.

When may medical-record copies be refused?

Article 21 prohibits refusal without a justifiable reason; incomplete identity or authority checks matter.

Article 21 contains the no-unjustified-refusal rule and its own conditions. The Ministry guidance identifies inability to verify the requester and defects in consent or authorization as examples. Those issues concern the request’s legal basis.

A missing signature or relationship document can be discussed as a particular defect instead of assuming that any delay or refusal has the same cause. The statute’s treatment-related proviso must also remain within its stated scope.

Can unpaid treatment bills block medical-record copies?

The guidance distinguishes an unpaid treatment bill from an unpaid copy-issuance fee.

Printed p. 236 of the Ministry handbook states that treatment-bill payment is not a condition for access or copies. Its Q 8 on p. 245 separately treats failure to pay the copy fee as a justifiable refusal reason. These statements concern different charges.

Keeping the bill categories separate avoids reading the records rule as cancellation of treatment debt or as a right to every copy free of charge. The fee notice still governs matching certificate items and units.

A bill can contain treatment charges and document charges at the same time. The two handbook passages answer different questions about those charges. If the institution refers to an outstanding balance, ask which part is being discussed and which request it affects. That identifies a concrete issue without assuming that treatment debt disappears when records are supplied or that a copy must be supplied without its applicable fee.

Must a doctor approve all medical-record copies again?

The guidance generally does not require another approval for records already created and preserved.

The handbook’s p 236 concerns existing records whose request conditions have been met. It says a further doctor’s approval is generally unnecessary in that situation. This is different from asking a doctor to prepare a new diagnosis certificate or opinion.

Identify whether an assessment must be created or whether the institution is retrieving a completed record. The statement does not establish that a particular requested document already exists or that every record can be supplied in any chosen format.

How can medical-record copies be delivered?

The guidance permits several delivery methods after a lawful request is confirmed.

Article 21(5) permits electronically signed electronic documents. The handbook describes paper, files or storage media and delivery by post, fax or email after lawful-request checks. It also discusses a requester-designated destination.

That establishes possible methods rather than a universal overseas-delivery or translation service. Confirm the specific medium, destination, recipient requirements and institution’s procedure without uploading a patient file to an unrelated preparation service.

Which original sources explain medical-record copies?

Read current Article 21 and Rule 13-3 with the handbook’s limited guidance on existing records.

The Act establishes access and third-party exceptions; the rule gives request documents. Annex 2-2 covers specified cases where consent cannot be obtained. The handbook explains handling of existing-record requests but is dated 2022.

Current forms and current rule requirements take priority over an older list in a guide. A patient can identify the document, request route and reason for a stated defect before seeking clarification about a specific unresolved issue.

The current consent form distinguishes access, copies and transmission to another institution. Its selected purpose and scope should correspond to the actual request. An older general guide can explain a principle while a current rule supplies a revised document list. Read both by function rather than copying every older requirement into today’s preparation list. The records checklist therefore treats relationship and age as separate inputs and does not ask for the documents themselves.
