# Can unpaid treatment bills block medical records?

> The Ministry guidance separates unpaid treatment debt from unpaid copy fees when explaining access to existing records.

The handbook says treatment-bill payment is not a condition for existing-record access or copies.

## How do unpaid bills and records relate?

The handbook says treatment-bill payment is not a condition for existing-record access or copies.

Printed p. 236 of the 2022 Ministry handbook states that unpaid treatment bills do not justify refusing record access or copies. It treats recovery of treatment debt as a separate matter.

This explanation concerns the existing-record request addressed by Article 21. It does not cancel a payment obligation or determine every issue in a billing dispute. Identify the outstanding charge and the record requested before applying the guidance.

Supplying a record and settling a treatment account address different obligations. The Ministry’s guidance on not making treatment payment a condition of a record request does not state that the debt is cancelled. It also does not give this guide authority to decide an individual billing dispute. If the institution describes a payment obstacle, identify the exact charge before applying either handbook passage. That keeps the request for existing information distinct from an argument about the underlying care bill.

**Separate the reason for the outstanding charge**

| Issue | Source distinction | Do not infer |
| --- | --- | --- |
| Treatment debt | Not a record-copy condition | Debt cancellation |
| Copy fee | Nonpayment separately addressed | All copies free |
| Identity or authority | Request documents apply | Billing dispute waives them |

## Why distinguish copy fees in unpaid bills and records?

Q 8 on printed p. 245 separately treats nonpayment of the copy fee as a justifiable refusal reason.

The Q 8 answer repeats examples such as inability to verify the requester or defects in authorization, and its footnote distinguishes an unpaid copy-issuance fee. That charge pays for the requested copy rather than the earlier treatment.

A request can therefore require identity and authority checks and an applicable copying payment even when treatment debt cannot be used as the refusal reason. The certificate-fee notice supplies item-specific upper amounts rather than a universal free-copy entitlement.

## Which request conditions remain for unpaid bills and records?

Patient identity and third-party request requirements remain separate from billing questions.

Article 21 permits the patient to request access and prohibits unjustified refusal. Rule 13-3 requires identity confirmation and specifies documents for relatives and agents. A dispute over treatment charges does not replace those checks.

A family member’s request may need kinship evidence and consent, while a designated agent has an authorization and patient ID rule. The age exceptions concern particular documents rather than waiving all checks for a minor.

## Does the rule for unpaid bills and records cover new certificates?

Existing copies and first issuance of a diagnosis certificate or opinion have different provisions.

The handbook’s p 238 separates first issuance of a diagnosis certificate, opinion or prescription from Article 21 records. Article 17 governs the specified certificate preparation and issue.

An existing certificate copy can be a record request, while a new clinical statement may require a different task. The unpaid-treatment explanation should not be extended into a claim that any new assessment or translation must be supplied immediately or without its applicable fee.

A first certificate may require preparation of a document governed by the clinical-certificate provision. The existing-copy discussion cannot settle every condition of that preparation. Similarly, a request for translation or a newly worded opinion should be described as that work rather than relabelled a free copy because a treatment bill is disputed. Ask what already exists and what must be newly prepared. The applicable document and fee rules can then be compared without deciding a clinical conclusion.

**Existing records and newly prepared documents**

| Request | Main basis | Preparation question |
| --- | --- | --- |
| Existing record copy | Article 21 and Rule 13-3 | Which dates and record categories? |
| New diagnosis certificate or opinion | Separate first-issuance rules | Does a clinician need to prepare it? |
| Bill and itemized costs | Benefit Rules Article 7 | Which receipt and details does the recipient need? |

## What should a refusal reason identify for unpaid bills and records?

Identify whether the stated issue is treatment debt, copy payment, identity, authority or a missing record.

The reviewed guidance gives specific examples rather than a rule that every refusal has one cause. An unclear relationship document or missing signature concerns the request’s authority. A copying payment concerns the selected item and unit.

The institution’s actual possession of the requested record is another fact. Clarifying which issue is being raised gives a concrete subject for further enquiry without this guide adjudicating a particular dispute.

## Are viewing charges the same issue as unpaid bills and records?

A 2024 government interpretation distinguishes viewing a record from issuing a copy.

The interpretation dated 26 November 2024 addresses whether Article 45(2) and(3) alone authorize a viewing fee. Its answer is negative within that question’s stated scope. It distinguishes viewing existing records from issuing certificates or copies.

This does not erase certificate-copy fees or settle charges under every other law. The source also explains that its interpretation is administrative guidance rather than a final court judgment with equivalent binding effect.

## How can the original sources clarify unpaid bills and records?

Use current access rules, the handbook’s two unpaid-fee passages and matching fee criteria.

Article 21 and Rule 13-3 set the request basis and documents. Printed pp. 236 and 245 of the 2022 handbook explain the two unpaid-charge situations. The certificate-fee notice defines matching items and units. These sources address different parts of one request.

Keep the current forms and rule requirements in view rather than replacing them with an older guide’s full document list. A specific unresolved dispute needs its own facts and competent enquiry route.

The handbook passages have printed page numbers that differ from a PDF viewer’s position count. Use the printed references supplied here to locate the treatment-payment explanation and the separate copy-fee answer. Read the current rule for the document list, as an older handbook may retain requirements later amended. Where a refusal reason remains unclear, a precise description of the requested record, requester route and stated reason is more useful for further enquiry than a general claim that all refusals are unlawful.
